In the normal course, employees will be hired, transferred or promoted between the minimum and midpoint of the salary range for a job.

Job Summary

As a member of the UBC Investigations Office, the Investigator requires experience and knowledge in investigations, including interviewing, applying a trauma-informed approach, report writing, and interpersonal, evaluative, problem solving and analytical skills.

This position requires a demonstrated ability to work effectively with diverse communities, including UBC students, staff and faculty, with a deep understanding and respect for the ways in which identity shapes an individual’s experience. The Investigator must also exercise a high degree of diplomacy and tact in liaising with stakeholders internal and external to UBC. The position requires a high level of emotional intelligence and maturity and the ability to maintain calm in challenging and complicated circumstances.

The role will be primarily responsible for investigating complaints of sexual misconduct under UBC Policy SC17: Sexual Misconduct and Sexualized Violence Policy and Policy SC7: Discrimination. Investigation files may involve other UBC policies and rules, including the Respectful Environment Statement and Policy SC18: Retaliation Policy.

The role requires recent and significant experience dealing with persons affected by trauma and traumatic situations, and demonstrated knowledge of procedural fairness, due process, trauma-informed practice, and the ability to apply policy, legislation and practice standards. Demonstrated knowledge of human rights is also required.

Previous education and/or applied experience facilitating Alternative Resolution Processes including Restorative Justice, mediation, and/or conflict resolution is preferred. Please note the role also

requires travel to the UBC Okanagan campus.

 Organizational Status 
The Investigator reports to the Director of Investigations.
The Investigator carries a high level of responsibility in the UBC Community. The role acts as a liaison between the UBC Investigations Office and other UBC-V and UBC-O units, as well as higher education entities and strategic partners, including VP-Students, VP- Human Resources, Deans, and other academic leaders, Department Heads, Directors, Executive Directors, and Associate Vice-Presidents at both UBC-V and UBC-O.
 

 Work Performed
–    Conducts investigations as assigned by the Director of Investigations, including:

  •  Interviewing parties and relevant witnesses using a trauma-informed approach

  • Making findings of fact

  •  Applying relevant law and policy, including human rights law and the law of consent 

  •  Preparing written investigation reports

–    Liaises and corresponds with all involved parties (including union and other representatives, as applicable) to gather information for investigations
–    Responds to complaints and investigation-related inquiries from internal and external parties
–    Identifies trends and patterns requiring further investigation, education or Alternative Resolution Processes
–    Conducts alternative resolution processes, where appropriate
–    Collaborates with other UBC IO staff in communications, education, analysis and administrative support in development and review of IO internal processes and procedures
–    Attends meetings for policy oversight and review, within the IO and with stakeholders as needed and/or requested by the Director
–    Works in cooperation with law enforcement agencies, regulatory bodies, third parties, and federal and provincial agencies as required

Consequences of Error/Judgement

The incumbent is in a high-level position of responsibility and trust, receiving highly sensitive and confidential information. Sound judgment and sensitivity are imperative to engender confidence in the credibility and integrity of the complaint and investigation process. The incumbent

is expected to exercise sound judgement and maintain strict confidentiality. The potential for negative impact on the University is significant. Error in judgement or procedure could lead to serious legal consequences and could result in the University’s failure to comply with federal and provincial human rights legislation.

Qualifications

– Master’s degree in a relevant discipline. 
– Minimum of 9 years’ experience or the equivalent combination of education and experience.
– Relevant degree disciplines include law, social work or social sciences.
– Recent and significant experience in administrative law
– Recent and significant experience in conducting investigations
– Recent and significant experience in carrying multiple investigative files at one time
– Recent and significant experience with investigative report writing
– Advanced knowledge of procedural fairness and due process
– Knowledge of investigative standards of practice and ethics
– Familiarity with the BC Human Rights Code
– An understanding of systemic social justice and human rights issues and how these impact various populations
– Knowledge and experience with trauma and working with people who have experienced trauma
– Recent and significant experience in trauma-informed investigation approaches
– Recent and significant experience engaging with people in crisis
– Demonstrated ability to conduct investigations in complex environments
– Strong interpersonal and diplomacy skills
– High emotional intelligence and maturity
– Effective organizational skills with ability to multi-task and prioritize to meet deadlines
– Effective evaluating, problem solving, analyzing and decision-making skills
– Attention to detail to achieve accuracy
– Ability to deliver results under pressure
– Proven intercultural competencies and an ability to effectively communicate and interact with members from diverse communities
– Ability to work in a fast-paced and constantly changing environment
– Ability to work well as part of a small, diverse and specialized unit
– Ability to manage priorities and shift according to the needs of the Unit
– Proficiency in Microsoft Office with strong computer skills
– Ability to be flexible and adaptable in a fast-paced environment
