Remuneration

This position is funded through a grant made available by the European Commission (EC Grant), whereby the Court will provide the selected candidates with a monthly remuneration of €1,500 (with a mandatory deduction for emergency health insurance) as well as some financial help for travel purposes for candidates who are not based in the Netherlands at the time of the recruitment. Please note that (i) costs associated with Visas are the responsibility of the selected candidate, (ii) due to the nature of the assignment, visiting professionals cannot bring their families with them.

Contract Duration

The Visiting Professionals funded by the EC Grant are required to work full time for a period of six months (dates to be agreed before the placement begins).

Background

The EC Grant aims to provide professional opportunities at the International Criminal Court (ICC) for legal representatives and/or other legal professionals from countries under investigation (situation countries), or countries under preliminary examination, or States Parties to the Rome Statute that are on the list of developing regions of the United Nation’s Statistics Division.

Preference will be given to female candidates from non-represented or under-represented States. The list can be found here.

The Opportunity

The International Criminal Court (ICC) investigates and, where warranted, tries individual charges with the gravest crimes of concerns to the international community: genocide, war crimes, crimes against humanity and crime of aggression. The Court is participating in the global fight to end impunity, and through the international criminal justice, the Court aims to hold those responsible accountable for their crimes and to help prevent the crimes from happening again. Organizational Context

Provided for in Article 79 of the Rome Statute, the Trust Fund for Victims (TFV) was established by the Assembly of States Parties in 2002.

Its mandate is to make visible the plight of victims, to mobilize resources and to implement Court-ordered reparations, and other programmes for the benefit of victims of the crimes under the jurisdiction of the ICC. The TFV is governed by a Board of Directors, appointed by the Assembly of States Parties, and that is supported by a Secretariat, administratively attached to the Registry of the ICC. The TFV has currently programmes in seven situations under the jurisdiction of the Court, and is implementing also programmes responding to four reparation orders issued by ICC judges.

The mission of the TFV is to respond to the harm resulting from the crimes under the jurisdiction of the Court by ensuring the rights of victims and their families through the provision of reparations in the context of a case and rehabilitation measures in the context of an ICC situation.

Whenever appropriate and feasible in the operation of its mandates, the TFV acts as a grant-making mechanism to locally based implementing partners. According to the TFV Regulations, the TFV receives administrative support from the Registry. In as far as not determined by the TFV Regulations, the TFV’s financial-administrative practice complies with the Court’s relevant regulatory provisions.

Duties and Responsibilities

Assist the Trust Fund for Victims with the following tasks, under the supervision and coordination of the Legal Adviser:

• Drafting of reports, observations in judicial proceedings, correspondence with legal representatives, and policies as required;
• Interact with Programme Managers and their team and various other staff members and stakeholders, in particular in order to write up implementation methods and collect knowledge and experience acquired;
• Keep databases, as required;
• Conduct legal research and analysis on questions of international criminal law, public international law, and other international and domestic legal materials, as appropriate;
• Cite checking of submissions before the Court;
• Support the TFV in procedures in regard to administrative eligibility screening in reparations proceedings;
• Other tasks as needed.

Required Qualifications

Education:

All Candidates must have a law degree at a recognised university. Candidates are expected to have a strong record of academic performance.

Experience:

Visiting Professional placements focus on candidates who have extensive experience in their professional careers in relevant fields of work. Candidates for a Visiting Professional placement must have at least 3 (three) years of relevant professional experience.

Knowledge, Skills and Abilities:

• Excellent legal analysis and drafting skills;
• Able to adapt to multicultural and multilingual working environments;
• Possesses strong teamwork skills (listens, consults and communicates proactively);
• Is able to work under minimum supervision;
• Has acquired a good standard of computer skills (including Microsoft Office applications).

Knowledge of Languages:

Proficiency in one of the working languages of the Court, French or English, is required. Working knowledge of the other is highly desirable. Knowledge of another official language of the Court (Arabic, Chinese, Russian and Spanish) is an asset.
